Local Law 126 Violations and Late Filing Help in NYC
Missed your filing window or received a DOB parking structure violation? We work out what you owe, get an acceptable report or amended report filed through a licensed QPSI, and fix the conditions behind the violation so the penalties stop growing.
How Do You Clear a Local Law 126 Violation?
You clear a Local Law 126 violation by fixing its cause; paying alone does not close it. For a missed filing, a QPSI must submit an acceptable initial report in DOB NOW: Safety. For an Unsafe or SREM violation, the conditions must be repaired and an amended report accepted. Remaining penalties are then paid, or waived where the rules allow.
Late filing costs $1,000 for every month the report is overdue. Once a full year passes with no filing, another $5,000 a year is added. An Unsafe condition left unrepaired after 90 days adds $1,000 a month, so acting early keeps the total down.
Key Facts
Late initial report: $1,000 per month
No report a year after the window: $5,000 per year
Unsafe condition past 90 days: $1,000 per month

Common Local Law 126 Violations and Penalties
These are the violations and charges DOB issues most often under Local Law 126 and 1 RCNY 103-13.
Late Filing Penalty
$1,000 per month from the end of your filing window until an acceptable initial report is filed.
Failure to File Penalty
$5,000 per year, added on top of late filing, once a year passes after the window closes.
Failure to Correct Unsafe Conditions
$1,000 per month after the 90 day repair period, until an amended report is accepted or an extension is active.
Failure to Correct SREM Conditions
A one-time $2,000 penalty when SREM conditions are not repaired as required.
Missing Initial Observation
An OATH/ECB violation for garages that had to file the one-time initial observation by August 1, 2024.
Rejected Report
A report DOB rejects does not stop the penalty clock; only an accepted report does.
Why Owners End Up With a Local Law 126 Violation
Most violations trace back to one of three gaps.
Filing Window Missed
The owner did not know the garage was covered, or booked the QPSI too late to file in time.
Repairs Stalled
Unsafe work was not finished in 90 days and no extension request was filed.
Paperwork Never Closed
Repairs were done, but no amended report was filed, so DOB still shows the violation as open.
How We Stop Local Law 126 Penalties From Growing
Most penalties are charged by the month, so speed matters. These four steps keep the total as low as possible.
Violation and Penalty Review
We check your DOB NOW: Safety record, list every open violation and work out what has built up.
Priority QPSI Scheduling
Our partner QPSI books the assessment or re-inspection quickly, so the penalty clock stops sooner.
Extension Requests on Time
When Unsafe repairs need more than 90 days, the QPSI files a request with a contract, a timeline and proof the area is secured.
Amended Report Close Out
Within two weeks of the repairs being finished, the QPSI re-inspects and files the amended report.
When a Local Law 126 Violation Can Be Challenged or Waived
Not every violation has to be paid. DOB accepts challenges and waiver requests in these cases, but each one needs proof.
Exempt Garage
Private garages for one- or two-family homes, auto repair, showroom and service station properties, and structures with fewer than three spaces.
Building Too New
The first Certificate of Occupancy was issued less than six years before the filing deadline.
Bankruptcy
A copy of an order signed by a bankruptcy court judge.
Full Demolition
The parking structure was fully demolished, with DOB sign off, before the inspection cycle began.
Declared Emergency
A declared state of emergency prevented the inspection, the filing or the repairs.

NYC Rules Behind Local Law 126 Penalties
Two parts of 1 RCNY 103-13 decide how much you pay and when the charges stop.
How Penalties Are Calculated
Late filing runs at $1,000 a month from the end of the filing window. If no report is filed within a year of the window closing, a $5,000 annual penalty is added on top.
Unsafe penalties start after the 90 day repair period. They keep running for any month without an accepted amended report or an active extension request.
Fees, Payments and Waivers
DOB NOW: Safety charges $305 for an initial report, $85 for an amended or subsequent report and $65 for an extension request. Penalties are paid in the same system.
A full or partial penalty waiver can be requested online, with a filing fee. An Unsafe repair extension can add up to 90 days, but financial reasons are not accepted.
Based on 1 RCNY 103-13 and DOB guidance on resolving parking structure violations.
What Affects the Cost of Clearing a Violation
Your total has two parts: what DOB has charged, and the work needed to close the violation. These six factors drive both.
Months Overdue
Each month without an accepted report adds $1,000 in late filing penalties.
Violation Type
Late filing, Unsafe and SREM violations carry different penalties and need different fixes.
Scope of Repairs
The number and size of Unsafe or SREM conditions set the repair budget.
Age of the Assessment
An assessment that is too old to file has to be redone before the report can go in.
Extension Timing
An extension filed before the 90 days end can keep Unsafe penalties from building up.
Waiver Eligibility
When a waiver applies, part or all of the penalty may be removed.

Local Law 126 Violation FAQs
How do I check if my garage has a Local Law 126 violation?
Search the property in DOB NOW: Safety, where parking structure filings and penalties are listed. The DOB Parking Structure Inspections Map also shows which filing cycle the garage falls under.
Does paying the penalty close a Local Law 126 violation?
No. The violation stays open until its cause is fixed. That means an acceptable initial report for a missed filing, or finished repairs and an accepted amended report for Unsafe or SREM conditions. Penalties are paid after that.
When do Local Law 126 late filing penalties stop?
They stop once DOB accepts an initial report for the garage. Getting an acceptable report filed is the only way to stop the $1,000 monthly charge.
Can I get more time to fix an Unsafe condition?
Yes. The QPSI can request an extension of up to 90 days, with proof the area is secured, a repair contract and a timeline. Financial reasons are not accepted.
Can Local Law 126 penalties be waived?
In limited cases. A full or partial waiver can be requested in DOB NOW: Safety, for example after a bankruptcy order, a full demolition before the cycle, or a declared state of emergency.
What if my garage is exempt but I still got a violation?
Submit a Waiver of Civil Penalties request in DOB NOW with proof of the exemption. You can also email DOB’s Parking Structures unit with the violation number, the address and your evidence.
What is the OATH violation for the initial observation?
Many garages had to file a one-time initial observation by August 1, 2024. Missing it can lead to an OATH/ECB violation with a hearing date, which is separate from DOB’s filing penalties.
Can an SREM rating lead to a penalty?
Yes, if the conditions are not repaired as required. DOB can charge a one-time $2,000 penalty, and the conditions can turn into Unsafe items that carry monthly penalties.
How long does it take to clear a Local Law 126 violation?
It depends on the violation. A late filing can be cleared as soon as an acceptable report is filed. Unsafe or SREM violations take as long as the repairs, plus up to two weeks for the QPSI to re-inspect and file.
